Terms of Service
Last updated
This is the agreement between you and us for playing LingoHunters. Tokens are licensed to you for use inside the game, not property you own: they cannot be sold, transferred or turned back into money, though they never expire. You need to be old enough to agree — 13 in most places, more where your country says so — and a parent or guardian has to agree with you if you are under 18. We can suspend an account for cheating, but we will always tell you why, a person will review it if you disagree, and if we ever shut the game down we will refund tokens you paid for and have not spent.
Summary
The short version. The rest of the page says the same things in more detail, and the detail is what counts.
- LingoHunters is a vocabulary game. You spend one token to start a round, find words in a letter grid against the clock, and earn tokens and experience for what you find.
- You need an account — a guest account with one tap, or Google or Apple sign-in. One account per person.
- You have to be old enough: at least 13, or more if your country says so. Under 18, a parent or guardian has to read this and agree with you.
- Tokens are not money. Earn them by playing or buy them with real money; either way they only work inside the game, and cannot be sold, given away or cashed out. They never expire.
- When you pay, you pay Apple or Google, not us. We never see your card details.
- There are no loot boxes. Nothing you buy is a random prize.
- Play fair. Break that and we can suspend your account — but we tell you why, and you can argue back to a real person.
- You can leave whenever you like, and ask us to delete your account. Nothing here removes a protection your own country’s law gives you.
If anything is unclear, write to [email protected] and we will explain it.
Who we are and how to reach us
LingoHunters is a vocabulary game for iOS and Android, together with this website at lingohunters.app. In these terms, LingoHunters, the game and the service all mean the app, the website, and the accounts, gameplay and purchases that go with them. We and us mean the people who operate it; you means the person using it.
The way to reach us for anything — a question, a complaint, a legal notice, a request about your data or your account — is [email protected].
LingoHunters is published by TRAVELERS CONNECTORS S.A.C., RUC 20612183695, of Jr. San Ramón 253, Urb. San Carlos 2da. Etapa, Comas, Lima, Peru. That is the company you are contracting with, and the company any legal notice should be addressed to.
Our Privacy Policy explains what data the game collects, and our Cookie Policy what is stored on your device. Both form part of your agreement with us.
Accepting these terms, and who may use LingoHunters
You accept these terms when you create an account, and again each time you keep playing after we have told you they changed. If you do not accept them, do not use the game.
You must be at least 13 years old. Where your country sets the bar higher, its rule applies instead: 14 in Peru, Spain, Italy, Austria and several other countries, and 15 or 16 in others. We use the age at which your country lets you consent to your own data being processed, because an account is exactly that.
If you are under 18 (or under the age of majority where you live), a parent or guardian must read these terms and agree to them on your behalf, and is responsible for what happens on the account, including anything bought on it.
The game does not ask your age and has no way to check one. The age rule is a condition of the contract, not something a screen enforces. If we learn an account belongs to someone under the minimum age, we will close it and refund the purchases made on it — a Google Play purchase we refund ourselves, and an App Store purchase we claim from Apple on the account holder’s behalf and pursue, because Apple is the only one who can return that money and a closed account cannot hold a token credit instead. If a parent or guardian tells us they never agreed to these terms for a child under 18, we treat the account the same way: we close it on request and refund unspent Purchased Tokens, by the same route.
These terms are between you and us — not between you and Apple or Google, even though that is where you get the app and where you pay. See the Apple annex.
Your account
Guest accounts. You can start playing as a guest with one tap. A guest account holds real progress but nothing you can sign back in with — no password, no address that identifies you. Lose the device or reinstall the app and that progress is gone. A guest account unused for 30 days is deleted automatically, unless it has made a purchase. To make progress durable, convert it into a permanent account by signing in with Google or Apple; your progress stays with it.
Lost sign-ins. A permanent account is signed into with Google or Apple, and LingoHunters holds no password of its own, so there is no password to forget or reset: recovering access to your Google or Apple account is handled by them. If you are locked out, write to [email protected] and we will help as far as we reasonably can, but we cannot restore access to an account we cannot verify is yours. To be exact rather than reassuring: the game cannot send email, because no mail provider is connected to it. That limit applies wherever these terms promise you notice “on a durable medium”: until the game can send email, that notice is a dated message in the app together with a dated, archived version of this page that you can download and keep, and once it can, it will be an email to the address on your account.
Keeping the account yours. One account per person. Keep your sign-in details to yourself, and tell us if you think somebody has got into your account. Your username is public — it appears on leaderboards, next to the avatar you chose from our set — so do not choose one that impersonates someone, that is a slur, or that would be offensive on a leaderboard. We can change a username that breaks that rule, and we will tell you when we do.
The licence we give you
We give you a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use LingoHunters on devices you control, for your own private entertainment and learning. That is the whole of what you get, and it lasts as long as this agreement.
The licence is for the game as it is when you use it. We do not promise a particular feature will exist forever, though we owe you what is set out in What we owe you and will not reduce the game without following Changes to the game.
You may not copy, modify, reverse-engineer or decompile the game, except so far as your local law allows despite a term like this, and you may not rent, sell, redistribute or sublicense it.
Fair play
Leaderboards, seasonal prize pools and referral rewards only work if people are honest. So: do not cheat — no modified clients, no tampering with traffic between the app and our servers, nothing that finds words for you. No bots or automation — no scripts, macros or automated play. No extra accounts to farm rewards, whether for referral bonuses, leaderboard positions, or claiming daily rewards twice. Do not exploit bugs: if a fault hands you tokens, progress or a ranking you did not earn, stop and tell us — a good-faith report is not a breach, and we may reverse what the bug produced. Do not attack the service, and do not use the game unlawfully or where sanctions or export laws say you may not.
If you find a security flaw we would rather hear about it: write to [email protected], give us a fair chance to fix it, and do not exploit it meanwhile.
How we moderate, and how you can contest a decision
If we restrict something — change a username, take back tokens or a leaderboard position, suspend or close an account — we will do all of the following.
- Tell you. Every time, we give you a statement of reasons: what we did, what it applies to, what led to it, the rule relied on, whether the decision came from automated detection or from a person, and how to challenge it.
- Let you challenge it, free of charge, by writing to [email protected] within six months.
- Have a person review it — not the system that flagged it, and not the person who decided first where that can reasonably be avoided. We aim to answer within 14 days.
- Put it right if we were wrong: we lift the restriction and restore progress and tokens where we can.
This route does not stop you going to a court or a consumer authority instead, or as well.
Reporting something to us
You can report anything in LingoHunters you think is illegal or breaks these terms. Send it to [email protected] with enough detail for us to find it — the username involved, what the problem is, where you saw it — and how to reach you. You may stay anonymous if the report concerns the sexual abuse of a child, and we will accept an anonymous report of anything else at our discretion. We will confirm receipt, decide without undue delay, and tell you the outcome and how to challenge it.
In proportion: LingoHunters has no chat, no comments, no messages, no friend list and no way to upload anything, so players cannot send each other anything. The only thing you write that another player sees is your username, on a leaderboard. A report here is therefore almost always about a username, about cheating, or about misuse of an account, and we are not going to describe a moderation apparatus we do not have.
Tokens
Tokens are the game’s currency: you spend one token to start a round, and tokens also unlock categories. Hints are free, three per round, and cost nothing. Most rules below differ by where a token came from, so we name the two kinds separately.
- Earned Tokens — won by playing: word rewards, daily rewards, streaks, achievements, tokens for watching a rewarded advert, referral rewards, and weekly and seasonal prize-pool payouts.
- Purchased Tokens — bought with real money, or granted as part of a paid subscription.
What a token is
A token is a limited, personal, non-transferable, non-sublicensable and revocable licence to use a feature of the game. It is not property, and buying tokens gives you no stake in anything.
We are not going to tell you tokens “have no value” — you paid real money for some of them. The accurate statement is narrower:
- Tokens are not exchangeable, redeemable or convertible into money, or into anything outside the game.
- Tokens are not transferable: you cannot sell, trade, gift or move them to another account.
- Tokens are usable only inside LingoHunters, and trading them or accounts outside the game breaches these terms.
Tokens do not expire — neither kind. There is no expiry date in the game and no process that clears an unused balance. Real-money prices are shown in your own currency at the point of purchase, before you confirm, with how many tokens you get.
No loot boxes
There are no loot boxes in LingoHunters, no gacha, and no random-reward purchases. Nothing you spend money or tokens on is a chance to win something: a token buys a named, specific thing — a round, a category unlock — and you know what it is beforehand. The words inside a round are drawn at random from the category you chose, rarer words appearing less often, but that is a game mechanic in a round you already started, not a paid random reward.
What happens to tokens if an account ends
- If you close your own account, unspent tokens of both kinds are lost — whether that closure is voluntary or at our initiative for a breach. Before you confirm, the app shows you exactly how many you are giving up. If you bought Purchased Tokens in the last 14 days and have not spent them, tell us before you delete: write to [email protected] and we will sort that refund out, ourselves on Google Play or as a claim to Apple on the App Store — see Your right to change your mind. We say before because the record of what you are owed is destroyed along with the account, and afterwards neither of us can reconstruct it. We will never require you to spend a balance, or to wait, before letting you delete.
- If we suspend or close your account for a material breach — cheating, automation, farming, fraud, payment abuse — we may withdraw tokens, including Purchased Tokens, where the breach is connected to them. We will tell you why, and you can contest it; if your challenge succeeds we restore the balance.
- If we close or restrict your account without you being at fault, we will not take away Purchased Tokens without reasonable advance notice, and we will give you a fair chance to spend them or ask for a refund of the unspent ones.
- If we discontinue the game, we refund unspent Purchased Tokens.
Earned Tokens are never refunded in money, because no money was paid for them.
Buying tokens and subscriptions
| Token pack | Tokens | Price |
|---|---|---|
| Small Token Pack | 100 | $0.99 |
| Medium Token Pack | 500 | $3.99 |
| Large Token Pack | 1,200 | $7.99 |
| Mega Token Pack | 2,500 | $14.99 |
Subscriptions: Plus at $4.99 per month or $49.99 per year, and Pro at $9.99 per month or $89.99 per year. What each includes is listed in the shop at the moment you subscribe, and that list is what we owe you, together with the bonus tokens it states. Prices are list prices in US dollars; your store converts them, adds any tax, and what it shows at checkout is what you pay.
In most countries Apple or Google is the merchant of record. Every purchase goes through App Store or Google Play in-app purchase, and we use RevenueCat to track what you bought so we can unlock it. Where a store instead sells as our agent, we are the seller and everything in these terms about refunds and your rights applies to us directly; you still pay through the store. We never see or hold your card details — your payment method and billing details are between you and Apple or Google, whose terms apply alongside ours.
Subscriptions renew automatically until you cancel, and you cancel through your store account, not through us, because we cannot cancel one for you. Cancelling stops the next renewal; benefits run to the end of the period you have paid for, and tokens already in your balance stay there.
Refunds. The two stores work differently, and we would rather say so than give you one tidy sentence that is half wrong. On Google Play we can refund a purchase ourselves, and we do. Write to [email protected] with the order number from your Google Play purchase history; we issue the refund from our Play Console and Google returns the money to the way you paid. A person does that at our end, so it is not instant, and Google takes its own few days afterwards. You can also ask Google directly, under its own policies. On the App Store, only Apple can put money back on your card — we never see your payment method, and Apple does not let a developer refund a purchase — so the claim goes to Apple, through your purchase history or at reportaproblem.apple.com, under Apple’s own policies. Where the law entitles you to a refund, or something on our side went wrong — an undelivered purchase, a duplicate charge, a fault that made what you bought unusable — write to us whichever store you bought from: for an App Store purchase we confirm the entitlement to you in writing so you can show it to Apple, and we put the claim to Apple ourselves, and if Apple still refuses, we credit the same value back to your account in tokens. That token credit is the remedy we can deliver on our own when the money is not ours to return; it is never an alternative to a Play refund we are able to make directly. Where a store sells as our agent, the refund is still made through that store’s own process. Your statutory rights, including the next two sections, are unaffected — where the law gives you a right to your money back, it is a right against the seller, and nothing here takes it away or asks you to settle for tokens instead.
Your right to change your mind
If you are a consumer in the EU, the EEA or the UK, you normally have 14 days to withdraw from a purchase of digital content or a digital service, without giving a reason. Wherever you live, we give you the 14-day withdrawal described below as a term of this agreement.
You buy tokens through Apple or Google, and their checkout asks you to agree to immediate delivery and to acknowledge that this ends the statutory withdrawal right for digital content; their receipt is the confirmation of that. We do not rely on that waiver for tokens. Consumer authorities in the EU treat in-game currency as distinct from the digital content it buys, and so do we.
So: if you ask to withdraw within 14 days of a purchase, we treat the Purchased Tokens from it that you have not spent as withdrawn, in proportion to what is unused, whatever the store’s checkout said. Tokens you have already spent bought a round or an unlock you received, and those stay bought. For a subscription withdrawn from within 14 days, the amount is what you paid less a proportionate share for the days you had the benefit of it.
To withdraw, write to [email protected] within 14 days and say so — a clear statement is enough, with no form and no reason needed. We act on it within 14 days. How the money comes back depends on where you bought: on Google Play we work out the amount and refund it ourselves from our Play Console, and Google returns it to the way you paid; on the App Store we work out the amount, confirm it to you in writing and put the claim to Apple, because Apple does not let us return money to your card. If Apple refuses it, we credit the same value back to your account in tokens. That is what we can do ourselves in that case; it does not replace your right to be repaid in money, which stands against the seller and, where a store sold as our agent, against us.
Changes to the game
We will keep developing LingoHunters, so it will change. We may change, add or remove features, but only for a valid reason, and these are the reasons:
- to keep the game secure, or to fix a fault or vulnerability;
- to keep it working with new versions of iOS and Android, new devices, or services we depend on;
- to comply with a legal or regulatory requirement, or a store rule;
- to keep play balanced and fair — token economics, reward rates, leaderboard and season rules — where an imbalance is spoiling play or being exploited; or
- to improve the game, or retire a feature almost nobody uses that costs more to maintain than it returns. If you spent tokens to unlock something we then retire, we re-credit those tokens.
A change under this section never costs you extra, and we will tell you in advance, on a durable medium (see Your account for what that means today), whenever one would affect your use of the game more than minimally.
If such a change negatively affects your access to or use of the game more than minimally, you may end this agreement free of charge within 30 days of being told, or of the change taking effect if that is later, and we will refund the unspent Purchased Tokens in your balance and the unused part of any subscription period — whether or not we also offer to keep the earlier version available to you.
If we discontinue the game
If we decide to shut LingoHunters down, we will give reasonable advance notice in the app and by any other means we have of reaching you, with the date it stops working; stop selling tokens and subscriptions as soon as we announce it; refund unspent Purchased Tokens at the value you paid for them, and the unused part of any subscription period; and leave a reasonable window for you to spend what you have and ask for your data. That refund is money, not tokens — a token credit is worth nothing once the game is gone. Where the store can make it, we make it through the store: on Google Play we refund the purchases ourselves, and on the App Store we put the claim to Apple. Where the store will not, we pay you directly, and the shutdown notice will say how to give us what we need to do it.
Earned Tokens are not refunded in money, since no money was paid for them. Progress, your Worddex (the collection of words you have found) and leaderboard standings end with the game.
What we owe you
We owe you a service in conformity with this agreement. We are not disclaiming that down to nothing — the law does not allow it, and it would not be honest. Concretely, we owe you that LingoHunters matches the description, quantity, quality and functionality set out here and in the store listing and works for the purpose a game of this kind is normally used for; comes with the instructions, support and updates you can reasonably expect; and is fit for any particular purpose you told us about before buying and that we accepted.
Updates. While we supply the game to you, we will provide the updates — including security updates — needed to keep it in conformity, and tell you about them. If you choose not to install one we made available and told you about, we are not responsible for a lack of conformity arising only from that, provided we explained the consequences.
For a subscription we owe conformity throughout the period; for a one-off token purchase, at the time of supply and for the period you can reasonably expect. We do not promise the game will never be unavailable, or free of every bug, or that a particular word, category or event will always be there — unless one of those takes it below the standard above.
If something is wrong
If LingoHunters is not what this agreement says it should be, tell us at [email protected] with enough detail for us to reproduce it. You then have these remedies, in this order.
- Bringing it into conformity. We fix it, free of charge, within a reasonable time and without significant inconvenience to you.
- A proportionate price reduction, or ending the agreement, if fixing it is impossible or disproportionate; if we have not fixed it in a reasonable time or without significant inconvenience; if the same problem returns after we said it was fixed; or if it is serious enough to justify acting immediately.
You do not have to wait for us to attempt a fix where the failure is serious, or where we have said we cannot or will not fix it.
If you end the agreement for a lack of conformity, we refund what you paid for the affected part — for a subscription, the period during which the game was not in conformity; for tokens, the unspent Purchased Tokens plus any purchase the fault made useless — within 14 days of us accepting the entitlement. Where your law places on us the burden of showing the game was in conformity, we carry it. None of this affects any other remedy you have.
Suspending or closing an account
We may restrict, suspend or close an account where you have materially breached these terms (cheating, automation, extra accounts, exploiting a bug, attacking the service, payment abuse); where it is being used unlawfully or for fraud; where the law, a court or a store rule requires it; where it belongs to someone below the minimum age; or where a payment is reversed and the tokens it bought have not been returned.
When we do, you get a statement of reasons every time, as described in How we moderate — we will not restrict an account silently — and reasonable notice before we act, except where the breach is serious and ongoing, where notice would let the harm continue, or where the law requires immediate action, in which case we tell you immediately afterwards with the same reasons. We match the response to the problem: a first, minor issue gets a warning or a limited restriction, and closure is for serious or repeated breaches. You can contest any of it, and a person will review it.
Tokens are treated exactly as set out in Tokens: forfeiture only for a material breach, and only with a stated right to contest; no removal of Purchased Tokens without reasonable notice where you were not at fault; unspent Purchased Tokens refunded if the game shuts down.
Closing your account yourself
You can stop using LingoHunters at any time, and delete your account and its data yourself. In the app: Settings → Delete account. You will see what is about to be erased, you confirm by typing one word, and it is done — immediately, permanently, and without needing anything from us. This works for guest accounts too.
If you have already uninstalled the app, or cannot sign in, Delete your account is the route from this website, and writing to [email protected] always works.
Deletion is permanent: progress, your Worddex, leaderboard history and unspent tokens of both kinds go with it. What stays is the purchase and subscription records tax and accounting law requires, with your identity detached from them, and — where someone else’s code brought you in — a referral record scrubbed of anything that identifies you. Delete your account lists exactly what is kept and why, and the Privacy Policy gives the periods.
Intellectual property
LingoHunters — the software, the word library with its definitions, images and pronunciations, the artwork, sounds, layouts, name and logo — belongs to us or to our licensors and is protected by copyright, trade mark and other laws. Nothing here transfers any of it to you beyond the licence.
Your content. There is very little you can submit: the game has no chat, no comments and no way to upload anything, so the only thing you supply that others see is your username. For that, and for anything you send us — a bug report, a suggestion, a support message — you keep whatever rights you have in it and give us a worldwide, non-exclusive, royalty-free licence to use, store, display and reproduce it in order to operate and support the game, for as long as we need it for that. For a username, that means showing it on leaderboards; nothing more. If you send us a suggestion we may act on it without owing you anything.
If you believe something in LingoHunters infringes your intellectual property, tell us at [email protected], identifying what you own, what infringes it and where, and how to reach you.
Our liability
We are responsible to you for loss we cause by breaking this agreement or by failing to use reasonable care and skill. That responsibility is not unlimited, but there are things we never limit.
We do not, and could not, exclude or limit our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- gross negligence or wilful misconduct; and, if you live in Peru, any loss we cause by our fault — dolo o culpa — because Peruvian law does not let us limit it at all;
- your remedies for a lack of conformity, or your statutory consumer rights generally; or
- anything else the law where you live does not permit us to exclude or limit.
Subject to that, we are not responsible for loss that was not foreseeable; for loss connected with a business — lost profit, revenue, interruption or opportunity, since LingoHunters is supplied for private use; or for loss caused by something genuinely outside our reasonable control, such as your device, your internet connection, or an outage at Apple or Google, beyond our own duty to keep the service in conformity.
Where our liability can lawfully be capped, our total liability for all claims arising in any 12-month period is limited to the greater of the amount you paid us in that period and US$50. The categories listed above are not capped, and if you live in Peru this paragraph does not apply to you. If your national law gives you more than this section does, your national law wins.
Governing law and where disputes go
These terms are governed by the law of Peru, where we are established. That choice matters far less than what follows, which is what actually protects you and which no choice of law can take away.
- You keep the mandatory protections of your own country. Our choice of Peruvian law cannot deprive you, as a consumer, of the protection of the mandatory rules of the country where you habitually live. Where Peruvian law gives you less, yours applies.
- You can sue us at home. You may bring proceedings in the courts of the country where you live, or where we are established, whichever you prefer.
- We will only sue you at home. If we ever bring proceedings against you as a consumer, we will bring them only in the courts of the country where you live.
Two things we deliberately have not done: there is no mandatory arbitration here, and there is no class-action waiver. You keep any right to take part in a collective or representative action, including one brought under Directive (EU) 2020/1828.
Complaints and dispute resolution
Start with us: write to [email protected] and tell us what went wrong and what you want done. Most things end there. If not, nothing in these terms stops you taking it further:
- EU and EEA — your national consumer protection authority or a certified alternative dispute resolution body; your European Consumer Centre can tell you which body covers a case like yours.
- UK — Citizens Advice, Trading Standards, or a court.
- Peru — INDECOPI; see the Peru section below.
- Elsewhere — your national or state consumer authority, and the courts.
One note on something you may have seen in older terms: the EU Online Dispute Resolution platform no longer exists. It was repealed and shut down permanently on 20 July 2025, and we do not link it, because sending you to a dead platform would itself be misleading.
Changes to these terms
We may change these terms, but only for a valid reason: a change in the law or in what a regulator requires; a change in the game or how it works; a change in a store rule we must follow; a change in security or fraud prevention; a change in what we charge or what a subscription includes, applied only to future periods; or making the wording clearer without changing its substance.
We will tell you in advance — at least 30 days before a change takes effect, on a durable medium, unless a shorter period is needed to comply with the law or deal with a security problem — and we will say what changed, and why. You can stop: if you do not accept a change you may close your account before it takes effect, and if the change reduces what you get more than minimally, the 30-day free exit and refund in Changes to the game apply. A change never applies backwards to a purchase you have already made. Continuing to play after a change takes effect is your acceptance of it.
If a court finds one part of these terms unenforceable, the rest stays in force, and if we do not enforce something straight away we have not given it up. You may not transfer your rights under this agreement; we may transfer ours to a company that takes over the game, but only where that does not reduce your rights, and we will tell you first.
Annex — Apple App Store
This annex applies if you got LingoHunters from the Apple App Store, and takes precedence over anything in these terms that conflicts with it.
- This agreement is between you and us, not Apple. Apple is not a party to it, and we, not Apple, are solely responsible for LingoHunters and its content.
- Scope of licence. The licence we grant is limited to a non-transferable licence to use LingoHunters on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including the Family Sharing and volume purchasing provisions of those Usage Rules.
- Maintenance and support are ours. We are solely responsible for any maintenance and support. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty. We are solely responsible for any product warranties, express or implied by law, to the extent not effectively disclaimed. If LingoHunters fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to LingoHunters, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to LingoHunters or your possession and use of it, including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property claims. If a third party claims that LingoHunters or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Our name and contact address. TRAVELERS CONNECTORS S.A.C., Jr. San Ramón 253, Urb. San Carlos 2da. Etapa, Comas, Lima, Peru. For questions, complaints or claims about LingoHunters, write to [email protected].
- Third-party terms. You must comply with any applicable third-party terms of agreement when using LingoHunters.
- Apple as third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
Annex — Regional terms
EEA and UK
Nothing in these terms affects consumer rights that cannot be varied by contract: the conformity and remedy rights in What we owe you and If something is wrong, the withdrawal right, the 30-day free exit on a materially reducing change, and the statement of reasons and human review of any restriction. Your minimum age is 13 unless your country sets it higher — 14 in Spain, Italy, Austria and others, 15 or 16 in several EU and EEA states. We are established outside the EU and the UK, so the law requires us to appoint a representative in each. We will name them here — name, address and email — before the game is released in those markets.
Peru
- Your rights under the Código de Protección y Defensa del Consumidor (Ley 29571) apply in full. A term excluding or limiting our liability for dolo o culpa, allowing unilateral suspension or termination without cause, terminating without prior notice, or waiving your right to complain to the authority, is void. Where anything in these terms would do that — the 12-month cap in Our liability, or acting before notice in Suspending or closing an account — it does not apply to you.
- Your right to unwind a purchase. Peruvian law does not give a general 14-day withdrawal right. Under Article 59 of the Código you may unwind a purchase within seven calendar days where we used an aggressive or deceptive commercial method. Our 14-day refund of unspent Purchased Tokens in Your right to change your mind applies to you in addition, as a term of this agreement.
- Minimum age: 14. Between 14 and 17 you may use the game with a parent’s or guardian’s agreement to these terms.
- Libro de Reclamaciones. We will publish a virtual Libro de Reclamaciones on this website before the game is released, linked from its front page as the rules require. Until then, send a complaint to [email protected]; we will register it, give you a numbered reference and answer within 15 working days, which is the legal deadline. Using it does not stop you going to INDECOPI.
- INDECOPI. You may take a complaint to INDECOPI at any time, and we will not treat that as a breach of these terms. If we ever bring proceedings against a consumer resident in Peru, we will bring them in the Peruvian courts.
United States
- No arbitration clause, no class-action waiver, no jury-trial waiver. We have deliberately included none of them. You keep your right to go to court and to take part in a class or representative action.
- State consumer laws. Some states do not allow the exclusion or limitation of certain warranties, or of incidental or consequential damages. Where that is so, the limits in Our liability apply only to the extent that state permits, and you may have additional rights.
- Children. Our minimum age is 13. The game is not directed to children under 13, we do not knowingly collect their data, and if we learn an account belongs to one we will close it and delete the data. See the Privacy Policy.
- Export and complaints. You may not use LingoHunters in violation of US export control or sanctions laws, and you confirm you are not on a US Government restricted-party list. Your state Attorney General’s consumer protection office and the Federal Trade Commission take consumer complaints; contacting them does not affect anything in these terms.
Australia
- Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
- Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
- The remedies in If something is wrong are in addition to those rights, and the limits in Our liability apply only so far as the Australian Consumer Law permits. Claims go to TRAVELERS CONNECTORS S.A.C. at the address in Who we are and how to reach us or to [email protected], and we bear the cost of making a claim.
